1. Acceptance of these terms

By visiting or using SpecialNeeds.org, you agree to these Terms of Use. If you do not agree, please do not use the site. If you use the site on behalf of an organization, you confirm you are allowed to accept these terms for that organization.

2. Who operates this site

SpecialNeeds.org is operated by Mama Mimi Inc., a Florida nonprofit corporation and 501(c)(3) nonprofit organization.

You can reach us at help@specialneeds.org for questions about these terms, corrections, accessibility problems, or privacy requests.

Facts Capital LLC is a separate for-profit company that operates MamaMimi.com. It is not the operator of SpecialNeeds.org and does not receive donations made to Mama Mimi Inc.

3. Who may use the site, and who may have an account

Anyone may read the public educational resources on SpecialNeeds.org without an account. There is no public account to create today — sign-in accounts are currently limited to our own editorial staff.

Email signup, submissions, and any account or community feature we offer in the future are intended for adults 18 years of age or older. Please do not submit personal information if you are under 18.

We do not knowingly collect personal information directly from children. If you believe a child has given us personal information, email us and we will remove it.

4. What this service is for

SpecialNeeds.org is an education, discovery and resource-navigation service. It helps families find and understand options: conditions and topics, organizations, programs, providers, funding, schools, events and community.

The site presents options and publicly available information. It does not tell you what to do, and it does not decide anything on your behalf.

5. No medical, legal, financial or professional advice

Nothing on SpecialNeeds.org is medical, mental-health, educational, legal, insurance, tax or financial advice.

• We do not diagnose, treat or assess any person or condition.
• Using this site does not create a doctor-patient relationship.
• Using this site does not create a therapist-client or other clinician-client relationship.
• Using this site does not create an attorney-client relationship.
• We do not determine or guarantee eligibility for any benefit, waiver, scholarship, grant, insurance plan or program.
• We are not a government agency, school district, health plan, benefits administrator, law firm or licensed healthcare provider.

Always talk with a qualified professional about your own situation, and confirm any program's rules with the organization or agency that runs it.

6. Emergencies

SpecialNeeds.org is not an emergency service and is not monitored for emergencies. If you or someone else is in danger or in crisis, call 911 or your local emergency number, or contact a crisis line such as 988 in the United States.

Messages sent to us are not read in real time and must never be used to report an emergency.

7. AI-assisted research, errors and update limits

We use artificial intelligence to help with tasks that may include research, source discovery, organization, classification, summarization, verification checks, contradiction detection, data maintenance and drafting. People make the decisions about what gets published.

AI can make mistakes, and AI output is not treated as authoritative evidence on its own. We try to ground factual information in external sources and show you where information came from.

Even so, information on this site may be incomplete, out of date or wrong. Programs change, funding changes, providers move, close, change insurance participation or stop accepting new families. We do not promise that every item is current, complete or error-free, and we cannot re-check every listing continuously.

8. Directories, listings and third-party information

The site includes information about providers, organizations, schools and programs, events, scholarships, grants, benefits, insurance, and complementary or holistic wellness services. Much of this information comes from the organizations themselves or from public sources.

Inclusion in a directory or on any page is not an endorsement, recommendation, certification or guarantee of quality, safety, licensure, availability or results. Exclusion is not a judgment either — most often it means we have not researched or received that information yet.

For complementary or holistic listings in particular: showing that a provider offers a service is not a statement that the service is effective for any condition. Those are two different claims, and we keep them separate.

Independently confirm credentials, licensure, services offered, insurance accepted, cost, geographic coverage, eligibility rules and deadlines before you rely on them.

The site links to third-party websites. We do not control those sites and are not responsible for their content, accuracy, security or privacy practices.

9. Funding, sponsorship and advertising

Mama Mimi Inc. is a nonprofit and may support this work through donations, grants, sponsorships, advertising, featured placements, sponsored newsletters or educational campaigns, affiliate or referral relationships, lead-generation arrangements and partnerships.

Where any of these exist, we will label them — for example as sponsored, advertisement, featured or paid placement — so you can tell paid placement from editorial research. Paying us does not buy a favorable review, a verification badge, or removal of accurate information.

If we would ever pass your personal information to a third party as a lead, we will ask you for clear, specific permission at that moment. We do not treat these terms or the Privacy Policy as permission for that.

10. Accounts and security

Today, sign-in exists only for Mama Mimi Inc. editorial staff; there is no public account signup, and none of the public resources require one. If we open public accounts, we will update these terms and the Privacy Policy first. Where sign-in is used, it may be through Google, in which case Google confirms identity to us and we receive basic account identifiers such as an email address. Use of Google's service is governed by Google's own terms and privacy policy.

You are responsible for keeping your sign-in credentials secure and for activity under your account. Tell us promptly if you believe your account has been used without your permission.

Staff and editorial permissions are granted only by Mama Mimi Inc. Signing in never grants editorial or administrative access by itself.

11. Reviews, submissions and corrections

You may submit resource suggestions, corrections, and organization or event information. Public review posting is not open yet; if we open it, reviews will be covered by these terms too. Everything you submit must be truthful and your own to share, and it must follow our Community Guidelines.

Honest negative experiences are welcome. What is not allowed is fabrication — an account of a service you never received, a fake identity, an undisclosed commercial motive, or someone else's private health information.

Submissions are reviewed by a person before anything is published. We may edit for clarity or length, decline to publish, or remove content. We are not obligated to publish anything.

By submitting content, you give Mama Mimi Inc. a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for formatting and accessibility, publish and display that content in connection with SpecialNeeds.org and the Mama Mimi network. You keep ownership of your content. You may ask us to remove content you submitted, and we will remove it where we reasonably can.

12. Prohibited conduct

You agree not to:

• post false, fabricated or deliberately misleading information
• harass, threaten, defame or target any person or group, or post hateful content
• publish another person's private information, including private health information, without permission
• impersonate anyone or misrepresent your affiliation with an organization
• post spam, bulk promotion or undisclosed commercial or affiliate promotion
• attempt to gain access to accounts, data, staff tools or systems you are not authorized to use
• scrape, crawl or bulk-copy the site in a way that burdens it or repackages it as a competing database, outside of our published API terms
• interfere with the site's security, availability or accessibility features
• use the site for anything unlawful

13. Intellectual property

The SpecialNeeds.org and Mama Mimi names and logos, the site design, our original writing, illustrations, and the organization, structure and selection of our database are owned by Mama Mimi Inc. or used with permission.

You may read, print and share pages for personal, family, classroom or professional-support use, with attribution. You may not republish substantial portions of the site commercially, or present our material as your own, without written permission.

Facts and links from government agencies and other public sources belong to their sources; we claim no ownership of the underlying public information itself. If you believe material on the site infringes your rights, email us and we will look into it.

14. Moderation, suspension and termination

We may remove content, decline submissions, or suspend or end access to accounts or features when these terms or the Community Guidelines are broken, when required by law, or to protect families and the integrity of the information here. Where it is practical and appropriate, we will tell you why.

You may stop using the site at any time, and where you have given us an email address or a staff account, you may ask us to remove it.

15. Disclaimer of warranties

The site and its content are provided "as is" and "as available." To the fullest extent permitted by law, Mama Mimi Inc. disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the information is accurate, complete, current, uninterrupted or error-free.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.

16. Limitation of liability

To the fullest extent permitted by law, Mama Mimi Inc. and its directors, officers, employees, contractors and volunteers will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data or lost opportunity, arising from your use of the site, from information found here, or from any provider, organization, program or third party you find through the site.

Where liability cannot be excluded, our total liability for any claim relating to the site is limited to one hundred U.S. dollars (US$100) or the amount you paid us for access to the site in the twelve months before the claim, whichever is greater.

Nothing in these terms limits liability that cannot be limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.

17. Your responsibility for your own content and conduct

If a third party brings a claim against Mama Mimi Inc. because of content you submitted or because you used the site unlawfully or in breach of these terms, you agree to indemnify and hold Mama Mimi Inc. harmless for that claim, including reasonable legal costs. We will let you know about the claim and cooperate reasonably with you.

18. Changes to the service and to these terms

We are building this site in public and will add, change or remove features. We may also update these terms. When we do, we will change the version number and the last-updated date shown on this page, and keep prior versions available.

If a change is material, we will make a reasonable effort to highlight it. Continuing to use the site after a change takes effect means you accept the updated terms.

19. Governing law and disputes

These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws rules.

Please email us first. Most problems — a wrong listing, a removal request, an accessibility barrier, a billing or donation question — are faster to fix directly, and we would rather fix them.

If a dispute cannot be resolved informally, it may be brought in the state or federal courts located in Florida, and you and Mama Mimi Inc. consent to the jurisdiction of those courts. Nothing here prevents either of us from seeking relief in a small-claims court, or from reporting a concern to a regulator or attorney general.

20. Severability and entire agreement

If any provision of these terms is found unenforceable, the rest stays in effect and the unenforceable part is applied only to the extent permitted by law.

These terms, together with the Privacy Policy, the Health and Information Disclaimer, the Community Guidelines and any feature-specific terms we publish, are the entire agreement between you and Mama Mimi Inc. about your use of SpecialNeeds.org.

Our failure to enforce a provision is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours to a successor that continues to operate the site under the same commitments.
